That would not be true.  Im assuming it was an asset purchase, as the 
assets of Novell included the Mono Business unit, to which they 
continued to maintain (even if a few days following the acquisition).  
So yes they have a legal obligation to all contracts within that unit as 
well.  What is worth looking into seriously is a class action suit, as 
not only is Attachmate on the line, but so is the D&O and business 
liability insurance carried by the companies.

The was a "wilfull" act on the part of the part of Attachmate the owner 
of the Novell "stock"/assets.  With that being said, the decision done 
by the executives and or board, will also have a liability to knowingly 
and willfully violate contractual agreements.

I do think if truly Attachmate has left MONO out to dry, the only 
pressure which would produce a resolution of releasing the IP, or 
monetary refunds, or damages - loss of revenue, cost of reorginzation of 
software, loss of investments, etc  would be thru some course of legal 
action.  They have already shown their feelings about not caring about 
the users of the product in the decision they have made, it would be 
foolish to think they will wake up tomorrow and have a change of heart 
and do the right the thing.

It it smells like, walks like a duck, guys its a duck.  Dont expect 
positive from them, when all to date has been lies, and under dealing.
