It's a shame you've got burned like this.
In the first place, the seller who sends the package must make the
insurance claim -- he is the one who has the paperwork and paid for the
insurance premium and if the insurance pays the claim, they will pay it to
the person who sent the package. So, this seller either doesn't understand
how the insurance system works or knows that you will get nowhere trying to file
a claim and doesn't care, because it will get you out of his hair.
I don't think you have any choice but drop a big fat negative feedback on
him and tell that you will remove it if he refunds your money. If he's so proud
of his perfect record he may do it. If not, you're probably out of luck.
I think everyone would agree that the chances of two packages to you in a
row being lost in the mail are astronomical -- unless the seller has got your
address wrong, like a digit misplaced or something, and has sent them both to
the wrong address. That can happen, but it's the seller's fault if it does, and
the seller has to make good.
Sadly, we are hearing reports of this kind of situation more often these
days and this is why -- despite their fees -- I urge people to pay with PayPal
and if the package doesn't arrive within 27 days, file a buyer complaint with
PayPal because they will do what they can to pressure the seller to refund your
payment. Most sellers aren't willing to risk losing their PayPal account and
will cough up a refund if you do this. But, if you don't use PayPal or you wait
longer than 30 days to file the complaint, you may be out of luck...
particularly if you let the seller stall you for 30 days or longer.
Of course, if you pay with a credit card you can dispute the charge with
credit card company and that will often get you the money back as well, but I
believe there's a time-limit on disputing the charge as well.
But If you sent a check or a money order, you're completely at the seller's
mercy, which is why I've been urging people never use those forms of payment for
ebay auctions any more.
Oh yeah, I would also file a complaint on the seller to eBay, for whatever
good it will do.

Yes you are supposed to believe that. I have sent two posters and don't
like being accused of not being true to my word. I have never been called a
liar before and take serious offence to that.
I have sent many posters to the USA and had no problems before I have 100%
positive feedback, because I go out of my way to send replacements. But I
won't continue to send replacements to you as I have done nothing wrong, I
have obtained proof of postage and insured the poster second time round and
made sure I have kept the receipt safe, as I have so many this isn't always
easy.
I also find it quite curious that every time I list another Chet Baker
poster you email me saying you haven't received yours. Perhaps you have
received the poster and are trying to get more posters out of me for free.
Now see how you like an accusation.
If the seller provided me with all the details of proof of postage I
wouldn't doubt him, especially if he has 100% positive feedback. If he had
questionable feedback I may be inclined to doubt him, but this is not the case
here.
I will be happy to forward you the details, if you would like a faxed copy
of the receipt I will be happy to fax you a copy.
But this is as far as our dealings will go, given your responses I'm afraid
I will not be able to deal with you in the future.

to make a claim.
