Actually, the U. S. Constitution says quite a bit about commerce. For instance, states were not allowed to interfere with interstate commerce, a view which it took 2 centuries for Europe to arrive at. Also there were provisions for copyrights & patents to protect the livelihood of authors, artists & inventors. Of course, the worst fault of the Constitution was allowing slavery & the slave trade. This problem preceded the Constitution by 100 yrs. and wouldn't be solved for another "four score and seven years". I suppose we could blame the Founding Fathers for not making credit default swaps unconstitutional, but I think we should look closer to home.
