A few things I noticed on the patents reffered in the "new encoder" page:


Patent 5570430 (FhG):
The use of Huffman tables with ESC codes is claim to be part of the patent,
but not the Huffman tables without ESC codes. Those would provide more size
reduction, but also more power needed for encoding and decoding.
The bit reservoir is also in this patent, but I think we don't need it in a
new encoder.
Some techniques for joint encoding in both frequency and time of spectral
coefficients are described, but not used in mp3 nor aac.

5040217 (AT&T)
Huffman tables with ESC codes are used in this patent, wich is prior to the
FhG one, so FhG can't have the patent of this tool.
PAC switches to M/S when the difference between the 2 channels is less than
2 dB (in Lame, 5 dB is used)


I also noticed that FhG patents are boring to read, while AT&T ones are
interesting.
