So the encoder would have a cow if it was using forced JS & that happened?

Is there a way to optimise the Joint Stereo encoding mode for surround sound systems? 
(I mean by allowing more bits into the 'side' channel) Or is that just a "Don't use 
JS" hint? heh heh heh...
