To a 'trained' ear (i.e. someone who's worked on the codec) things are
much less transparent then the average joe.
On some samples with mp3, 320k is not transparent to such listeners on any
sound equipment (I believe that the non-linear responce of lowend PC
speakers actually makes it more obvious)

If you are going to make an incompatible format, why not go all the way
and fix all of MP3's stupidness.
Take a look at vorbis.
