What do you mean by this? Drunk driving is not legal.
You can get put in jail for drunk driving. You
cannot get put in jail for smoking in the smoking
section of a bar.
I believe to make the two similar, you need to make
smoking illegal. Which I also believe is the ultimate
goal of those who wish there was a smoking ban.
