Bill - I really respect you as a landlord so I would like to hear your opinion of the CCP/SAFE Crime Free Multi Housing Lease Addendum. This addendum is used in public housing and the contents have been upheld by the courts.
The addendum requires the tenant to sign a document voluntarily agreeing to avoid criminal behavior. Drugs, prostitution, guns etc. are the crimes mentioned. The addendum states that if the tenant, tenant guests or other members of the household participate in any of these crimes based on a "preponderance of the evidence", the tenant agrees to leave the premises voluntarily. Evidently, this helps the landlord avoid costly housing court expenses. The tenant always reserves the right to go to court if they feel they were unfairly evicted. I would think this would be a win win for a lot of groups. Tenants might not be turned away as readily if they agree in writing to avoid criminal behavior or leave. Landlords could take more risk knowing that it is now easier to make them move when they become "problem tenants". The county saves money not having as many costly housing court sessions. I would think landlords would be jumping to implement these addendum's to their leases. I would like your opinion and other rental property owners or tenants opinions as to why this lease addendum is a bad idea.
