Park Board Commissioner Bob Fine is showing that he is concerned about
getting reelected in his race for Park Board against an aggressive
challenger, Jim Bernstein. He has filed an election complaint against Jim
Bernstein. One part of the complaint was fair - that was that Jim
Bernstein's ad in the Southwest Journal didn't have the required
disclaimer. According to Jim Bernstein, this was a mistake. When
candidates make these types of mistakes they do deserve fines.
The other parts of Fine's complaint have the goal of bullying opponent Jim
Bernstein into shutting up about Fine's appalling record on the Park Board.
It seems that Commissioner Bob Fine shares superintendent Jon Gurban's and
Park Board Lawyer/Lobbyist Brian Rice's disregard for the first amendment
of the constitution.
De-Fining Bob Fine's Park Board record is a fair campaign issue. Jim
Bernstein is getting under Fine's skin, and Fine is responding predictably.

You may remember our post just prior to the primary, reporting that Ward 8
City Council candidate Marie Hauser had used Park Board candidate Mary
Merrill Anderson's name in piece of campaign literature. Anderson was not
pleased, because it implied an endorsement of Hauser over Jeffrey Hayden,
who is Anderson's nephew. Anderson subsequently filed a complaint. Today, a
ruling came down asserting that there was probable cause that Hauser had
distributed misleading campaign materials. The case has been forwarded to a
three-judge panel for an evidentiary hearing. Hauser, for her part,
continues to claim that she was only trying to help Anderson's campaign by
mentioning her in the piece.
EY: I understand through a source who has talked with Anderson that
tomorrow (Monday) will be their third appearance at 10 a.m. This will be
the third hearing. The prima facie, then the finding of probable cause.
Tomorrow's appearance is the discovery, which is where she's produces
exhibits (physical evidence). The next step is prosecution in Hennepin
County court.
According to my source, Anderson is determined to see this through. I'm
kind of surprised that there hasn't been more press coverage. I guess there
is a Mpls Observer piece and that Insight is planning to do something.
Marie Hauser would have been better off taking responsibility and
apologising publicly to Mary Merrill Anderson.
