On Oct. 12, Fine filed a complaint against Bernstein with the state Office
of Administrative Hearings, saying Bernstein's literature contained false or
distorted statements of Fine's position, and that a Bernstein ad in the
Journal was deceptive, lacking the appropriate disclaimers.

A probable cause hearing was set for Oct. 18, after this issue went to
press.

In part, Fine's complaint said Bernstein distorted his position on the
proposed Lake Calhoun Sailing village, suggesting Fine supported lining the
Chain of Lakes with high-rises. Fine said he has never supported such
structures.

Bernstein said his literature and ads were fair, and that Fine had not
opposed the Sailing Village. Bernstein called the complaint a sign of
desperation.
