If they are managed as clients, then you do need an ML for them the same as any other managed system.
If you are truly talking about BDPs in ConfigMgr 2007, then those have to have an ML on them because they have to be clients. If we are talking about ConfigMgr 2012 or CB, please don't call them branch distribution points because that's not what they are. For hosting any actual ConfigMgr site roles though, there is no licensing fee whatsoever regardless of location or role of the server hosting the role. There wasn't in 2007 and there isn't in 2012 or CB. If your LAR (or whatever they're called now since Microsoft renamed them) is telling you differently, I'd suggest finding a new license reseller.
