When I first got my Pace56K external modem it did exactly that.  In my
case it was because the modem firmware was K56Flex type instead of V90
which the ISP didn't like much, so it always dropped back to non-56K
modes.

You can check which version of firmware you have by using a terminal
program and typing "ati4" it should return a version string. Less than
V2.00 is K56 only I think. Pace have upgrades to the firmware on their
website in either K56 or V90 flavour, BUT before I get everyone
shouting, be very aware that you need a few minutes to upgrade your
modem and if you get a power cut or crash in that time you will very
likely wreck your modem.... :-o  Also be careful to follow the
instructions *exactly.*  Mind you, I upgraded mine quite happily with
no problems whatsoever.
