Yes it is a separate product.    I can go and buy NC3 without having
(or needing) NC2 to make it work  - In theory at least, in practice
without the stuff from NC2 it doesn't work properly, but that's a
different story.

If I had bought NC3 without previously owning NC2 I would have a
complete product.     If I then bought NC2 and sold it to someone,
that would not be illegal (or immoral) unless I continued to use it.
When Active offered me the complete NC3 product at a discount price
because I was pre-ordering, that did not affect my legal rights to do
with NC2 whatever I want, provided I do not continue to use it and
sell it as well.

If Mr Ford sells me a new car at a discount because I pre-ordered and
was a loyal Ford owner, that does not mean I have to give him the old
car.    My contract with Active did NOT specify that I had to return
NC2 and it is against the Trades Practices Acts of both Australia and
England for a trader to introduce retrospective conditions to a
contract.

I own (and will, until I choose to sell it) NC2.   I also own NC3.  
Ownership of one does not diminish my onwership of the other.
