I think so. But governments often may have no facility of their own to
make use of shape files. So what they can use may be either hard copies
or jpg files. That could be the reason why they have asked for jpg
files.

Yes, the government should be. I have heard that, in the case of any
software work that is done for the government, the ownership of the
source code rests with the government by default. If that is true, by
extrapolation, the shape files also should belong to the government
because, in a way, that is the "source" for the jpg files.
