Quibble: 
irrespective of wether coyright is enough or not, software is  
mathematical algorithm and it's novel / new / unique use constitutes 
discovery not invention. Mathematics and it's expression in software 
cannot be patented.

Using the adequacy argument will neatly divert the real ( not 
patentable ) issue.
