Correct me if I am wrong, but the issue I thought we were debating was the restriction on commercial distribution and not on freedom to produce derivatives (which can be done even when commercial use is restricted). The license says
You are free:
    * to copy, distribute, display, and perform the work
    * to make derivative works
Under the following conditions:
     Attribution — You must give the original author credit.
      Non-Commercial — You may not use this work for commercial purposes.
