The big problem here (and one that we can use to our advantage) is that
it is not a democratice process at this time.

The (elected politicians) took the proposed legislation from the
(unelected) Commission  and made changes specifically to leave software
out of the legislation.

The Council of Ministers then ignored the changes to the proposed
legislation, reverting back to the commission's report.
