I don't think you can hold the dealer or salesman accountable for it. As a
buyer it's your responsibility to assume the salesman will tell you
whatever he thinks you want to hear to buy the object he's selling. That
said, I would replace the tires immediately. Whether they appear to be in
good condition or not I wouldn't take a chance on something so essential to
keeping the shiny side up.
