The more immediate causal agent would be the party that fired the weapon. Even if we granted that Hamas were using civilians as human shields (which is not at all clear to me -- I notice that the videos you've produced as evidence have come from the same source, one I never heard of before) I would expect a cop who shot a baby in a hostage situation to turn in his badge pending inquiry.
