For operating their own insecure servers, or for simply passing traffic? For passing traffic: I don't think the ISP should be liable, unless they've been alerted to a problem and then ignore it. ISPs, IMNSHO, are common carriers. The phone company can't be held responsible for what you say on the phone. The only time they get involved is if you're causing the phone network harm. It should be the same for ISPs. For operating an insecure server of their own: They should not be treated any differently than any other company that is the source of a problem.
