IMHO, you're splitting hairs. Yes, it's a software upgrade, but it's upgrading 
the CPU, which is a main component of the hardware. That's like buying a 6 
cylinder car, but only being able to use 4 because the on-board computer won't 
"turn on" the other two cylinders. Sure you get what you paid for, but it's 
going to bug you that you have two cylinders you can't use, due to software 
restrictions. If I'm buying a 6-cylinder car, I WANT to be able to use all 6 
cylinders. If I want a 4 cylinder car, I'll buy a 4 cylinder car.
