How can that be? The person who placed that material there must be authorized by Wizards to enter into contracts on their behalf, or else Wizards could simply turn around and say _nothing_ is Open Content.




For WOTC to claim nothing is open content, they'll need to show they never intended for anything to be open content, which is hard to do -- nigh impossible, in fact. It is, however, trivial to demonstrate to any fair jury's satisfaction that the words 'Dungeon Master' were entered by accident.
