You're making the mistake of looking at WotC in terms of a faceless monolith. Try breaking it down into individuals and it might make more sense to you.

The cure period applies when a third-party publisher doesn't have the 
right to use another publisher's content. WOTC has the right to do 
anything it wants with its own content.
