It might be more useful than just windows dressing.  If the spirit is agreed
upon by both parties, it would be useful in determining whether or not a
party was acting in good faith.

I'd like to point out that GNU has no such arbitrating authority, and free
software lawsuits are quite rare compared to the volume of free material.
