I'm pretty sure that if I slapped "Just like Vampire:The Masquerade!" or "d20 rules for Warhammer!" in my game I'd get smacked by WW or GW. Quite simply, "you're wrong." If someone wants to use a trademark, they can ask. It's just that simple. (For example, if www.planewalker.com was going to convert all of the old PS material to d20, they could still use the PS logo in the 'closed' section of their work because they have permission, via WotC's online policy for the old TSR properties.)
