Subject: Re: [Open_Gaming] Take (and Tilez)

I, as well have my dice pool game available, OGLed, and everything
available for download. I could've had this available much sooner, but
layout was bugging me. As a side note, I created 4 (probably 5) pdfs
before I got to this final version. Also like I mentioned previously,
this is not very long, and the license takes up more space ;-)
Well, here's a 3 page 25K pdf file ...

Very nice. I could see some interesting variations already, primarily in the
realm of tournament rules. I like how you've abstracted the combat out into
a simple system that can be learned and played in a short session.

Have you added it to the Registry yet? Tilez and Take are now there.

Now here's an OGL question I missed, because it's not how I really hope to
use OGL: what does the OGL require me to do in order to post Arena OGL to my
Web site, unmodified, as an example of what we might call "Open
Distribution"? Let's look at a literal interpretation of the terms:

****************************************************************

1. Definitions: ... (g) "Use", "Used" or "Using" means to use, DISTRIBUTE,
copy, edit, format, modify, translate and otherwise create Derivative
Material of Open Game Content.... [Emphasis added.]

****************************************************************

So Distribution is "Use" as covered by the OGL. Clear enough.

****************************************************************

4. Grant and Consideration: In consideration for agreeing to use this
License, the Contributors grant You a perpetual, worldwide, royalty-free,
non-exclusive license with the exact terms of this License to Use, the Open
Game Content.

****************************************************************

OK, so I have license to Distribute (i.e., "Use") as long as I comply with
the license while so doing. Clear enough.

****************************************************************

6.Notice of License Copyright: You must update the COPYRIGHT NOTICE portion
of this License to include the exact text of the COPYRIGHT NOTICE of any
Open Game Content You are copying, modifying or distributing, and You must
add the title, the copyright date, and the copyright holder's name to the
COPYRIGHT NOTICE of any original Open Game Content you Distribute.

****************************************************************

Now call me a nitpicker, but this says "must", and it says it twice. In
other words, a strict interpretation says I CANNOT Distribute it unmodified.
I must, at a minimum, "update the COPYRIGHT NOTICE portion of this License
to include the exact text of the COPYRIGHT NOTICE of any Open Game Content
You are copying, modifying or distributing". Since I am contributing no new
content of ANY kind, I am not further compelled by Section 6.

Now I could just ask your permission to Distribute. Don't want to. I could
just post a link to your own Distribution. Don't want to. What I want is to
explore the rights granted to me (and others) under OGL, probing for soft
spots. This looks like a soft spot. If it can be resolved, I do intend to
Distribute Arena OGL through my site. But right now, it appears that the OGL
prevents me from doing so without modification (and I don't have the Acrobat
tools to do that, either).
