It depends on if PEG used "Hell on Earth" in "Deadlands d20". If DD20 happened to contain HOE as either PI or OGC then there are going to be difficulties. If it were part of the PI then you can't even use it at all. On the other hand, if it were released as OGC, then you can go ahead and release HOE and send it out, but anyone and everyone is allowed to use it as well since once something's been opened it's extremely difficult to close it back up.

Now if HOE just happened to be what you called it, then you can claim it as either OGC or PI and then PEG would be under the same strictures as those I mentioned.
