There's another case: What if it's open but the company says it 
isn't? If I'm deciding what open content to use in a work, I don't 
think it makes much sense to ask the creator of the content to 
personally clarify its open status. If I have to ask, there's an OGL 
problem with the content that an e-mail exchange isn't going to 
correct.
