Um. Your first staement was:

What people are telling you is that it DOES matter if it is derivative. A
piece of artwork that is derivative of OGC *must* be OGC.
BUT if you REDESCRIBE a creature and attach the "stats block" of the SRD
rust monster, your description is not derivative as long as it does not rely
on either the SRD description of the creature or the D&D description. This
is also true evenn if you call it a Rust Monster, because you are licenced
to use the term.
It DOES matter if it is derivative. But in this case it would NOT BE
derivative. (At least I think that is what you meant to say?)
