A good data point is WEG's D6 system. Countless games prior to it have 
used six-sided dice exlusively. I'm sure people described them as "d6 
systems". But WEG has succesfully trademarked "The D6 System", and has 
created several variants, such as "D6 Prime" and "D6 Legend".

If they can do that with d6, WOTC can do it with d20.

The difference is, to get Clintonesque for a moment, the difference 
between "the" and "a". "A d20 system" is any system which uses twenty 
sided dice. "The d20 system" is the specific system created by WOTC and 
used in D&D, Star Wars, etc.
