The issue is whether you (or anyone) has a right to be on the d20 Modern list and see the material before its actual publication. The answer to that question is of course a resounding NO. The only reason WotC has for granting anyone access to d20 Modern prior to publication is to get supplemental material available during the first 6 months or so following the release of d20 Modern. After that everyone has access, so it shouldn't be a big deal. In making the decision on who to include in such a group then, WotC has every right to exclude anyone they wish. If you haven't produced anything yet, how can WotC even judge if you're capable of producing a product to help establish d20 Modern in the marketplace? On the other hand, if Necromancer games appears to be purely focused on fantasy, why should they be included just because they've put out d20 material? Anyone who does not intend to have d20 Modern product available by May '03 really has no valid reason to be on the d20 Modern mailing list. Anyway, Anthony never said that you wouldn't be considered a publisher for the purposes of joining the d20. If you intend to produce d20 Modern material, by all means fill out the NDA and send it in. Perhaps include a letter explaining who you are and what you are planning on doing.
