I thought that was the case -- but in a number of places online today, I've
seen Eden Studios, announcing their monster book is gone to press, declare
that it's "totally compatible with 3rd Edition D&D."  E.g.:

Not sure if that clause of the D20 SRD slipped their mind, or if they figure
no one cares what you write online to promote the book, only what you print
on the book itself (where I assume they did not use the trademarks in any
unauthorized way)...
