And he loves the spell name "Clark's Colorful Casting" and he contacts me. I can license the right to use that name to him. Why would he do that? Because he doesnt want to make a d20 product so he doesnt want to follow the OGL/d20 licenses. Taking a greater example, lets say I create the Kingdom of Clark campaign setting with 10 city names and 10 races and 10 gods and 10 character class names. As long as these are my creation and not derived from the SRD (which they would not be) I own that content. If I release "d20: Kingdom of Clark" I still own the rights. I have just granted to everyone the right to use that content under the OGL. It DOES NOT mean I have given up my rights to that content. I have just licensed it. Just like WotC, by licensing the content in the SRD, does not give up their rights to that content. Of course, if my creation is derivative of the SRD and thus only usable by me as a result of the OGL, I couldnt do this. But most things--stuff that is usually designated as PI--that are not game related are yours. You dont forfeit that. Back to the Kalamar thing. Kenzer is not using the OGL. Just like me licensing "Kingdoms of Clark", WotC can license the stuff that they released in the SRD. They dont lose the right to do that. So when Kenzer makes an official product, or SSS makes a Ravenloft product or whatever, that is as a result of a seperate license.
