Interesting. I had assumed that phrase meant that the Vp/Wp rules were not
covered by the license, but what it is stating in fact is that the Vp/Wp
rules were taken from sources that are not open content. This is required by
the OGL, because the only content you can have in a work covered by the OGL
is OGC from other sources (like the SRD) and work you have the authority to
contribute (either you own the copyright or you have permission to use the
material). Then they state a source which they do not own and are not OGC,
and state it is used with permission. It states elsewhere that everything is
open content except PI and (list), and does not exclude Vp/Wp rules.

It remains to be seen whether or not AEG intended this, but depending on the
wording of the license between WotC and AEG, they might have the authority
to do it.
