Lets say you made the spell "Clark's Conjuration" and
also provided the stats as follows:

"Clark's Conjuration
Conjuration
Level: Sor/Wiz 9
Range: Anywhere
Duration: 1 day
Spell Resistance: None
Save: None

Clark's Conjuration was developed by the powerful evil
Necromancer, Clark. Though lacking in a scary name
appropriate for an evil Necromancer, Clark
nevertheless is one of the most powerful wizards in
LameWorld. Living in CreepyCastle, Clark's Conjuration
can only be obtained by trading Clark free copies of
d20 products.

Effect

When cast, Clark's Conjuration summons any one person,
creature, monster or item of up to 1 ton immediately
to any location of the caster's choosing and is under
the service of the caster for the duration of the
spell. At the end of the spell, the person, creature,
monster or item summoned is returned to its original
location. The spell effects persons, creatures,
monsters and items from other planes without
limitation."

Lets say I have 10 or more similarly cool spells with
names of other NPCs from LameWorld.

OK, so that is my cool spell (plus 10 more other
hypothetical ones) and I want to make it OGC. BUT (and
this is a big but) I really want to preserve the name
"Clark". We cant have the name "Clark" becoming
OGC!!!! Plus, there is all that cool stuff from my
game world--LameWorld--and my cool lair
name--CreepyCastle. So how do I protect all that
stuff? Well, I make the spell stats OGC and everything
in "Effect" OGC. That leaves the first paragraph out
of OGC. Then I can PI the name, or just the element
"Clark" and provide a license for its use.

For example:

Open Game Content: The following is designated as Open
Game Content: The stat blocks of all spells within
this email as well as all content contained in each
spell description under the heading "Effect," subject
to the Product Identity Designation below.

There is two ways to do PI:

1. The easiest way (because it is a blanket
designation):

Product Identity: The following content is hereby
designated as Product Identity: The names of all
spells.

2. The specific way (harder, because it requires more
detail in that you designate each actual thing that
you want):

Product Identity: The following content is hereby
designated as Product Identity: The names Clark, Bill,
Steve, Stewart, LameWorld, CreepyCastle.

License:

Then just provide the license for use:

ClarkGames hereby grants an worldwide royaltyfree
license allowing the use of the Product Identity
detailed above on the condition that said Product
Identity is only used in conjunction with the spell
names contained within this product.

Then, if you use one of my cool spells, you would put:

15. COPYRIGHT NOTICE

YourProduct Copyright 200?, YourCompany, Author You.

Clark's Cool Spells Copyright 2003, ClarkGames, Inc.,
Author Clark Peterson.

Notice: This product contains material from Clark's
Cool Spells that was designated as product identity
and is used by specific license.

Hope that helps.
