The commercial version does not fix the problem. In fact, the
author even went so far as to remove the initial blue font that was indicative
of original OGC from the SRD so the casual reader who may not be familiar with
the SRD will have no clue about what is or isn't OGC. The declaration from the
commercial product reads:

The publisher did receive preliminary approval from
Wotc (it was required before RPGNow would post it again) but I suspect that Wotc
should be made aware of this declaration and possibly take a closer look at the
book.
