If they are tied to no mechanical system, they have no effect on game. Once I can determine the effect on my character the text has, it is a game mechanic and must be OGC.1: not all game mechanics must be OGC. The WotC OGL only requires you to make OGC those things which are derivative of OGC--whether they be mechanics or something else. You can keep mechanics closed, and possibly make them PI [i seem to recall someone on this list pointing out that a strict reading of the WotC OGL might lead to the conclusion that all mechanics within OGC must themselves be OGC, thus making it impossible to PI mechanics.] You can make story elements (and all the other bits from that laundry list in the license) OGC, or just keep them closed.
2: "This spell kills all those who can see the person invoking it." is derivative of something in D&D/D20SRD? Or it has no effect on the game? It seems to me that it's perfectly possible to craft mechanical elements for a D20 game which have no derivation from the D20SRD.
