Because, in some cases, grub2 doesn't install in root partition while

Must be some misconfiguration. Advantages of grub legacy are that
(some) people should be more comfortable with it, e.g. I did a lot
of grub hacking starting in 2000, so I know almost all of its
internals, not so much of grub2. Other big advantage is gfxboot.
I do not think SuSE wants to throw away all the work they did in
gfxboot, so worth to look what they are doing.
Major problem with grub legacy is that it relies on a lot of
"ancient" gas and gcc behaviour, and that can break easily if
only we are using it. It already broke with gcc 4.6 and required
some debugging and use of an "obscure" gcc option to regenerate
a working boot loader.

Grub legacy options to create themes (with gfxboot patches) is
a lot more powerful than what is grub2, but upstream grub2...

Hm, actually better possibilities for creating themes was the reason we quickly switched to Grub2 in ROSA Desktop Fresh.

Though we had to develop a lot of patches for grub2 to implement the ideas expressed by our designers, it was easier to patch grub2 then to work with grub-legacy (though maybe our developers didn't have enough experience with gfxboot, but what was the need for them to investigate legacy stuff?).

We have some guidelines for Grub2 theme development on our wiki (and btw, these guidelines are referenced at upstream site):
