I think that charitable distribution counts as "in commerce" for trademark use
- especially since products authored with openKard would be able to be sold. I
assume that openKard will be able to make standAlones that could tehn be sold
- without licensing? As long as they do not use the openKard TM?
Yes, patenting software is generally more headache than help, and(if memory
serves) you can't simultaneously claim trade secret and patent protection
