I will leave it to you and others with a better understanding of the law to
make this determination; but here's a little more from Nolo Press:
"Federal registration is only allowed for marks that are in use in
'commerce.' Commerce is defined in this context as business or trade which
the federal government, through the U.S. Congress, may control."
