I think that's flawed. There is no way to determine what licenses may or may not apply to a given bit of source code by looking at the object file produced. Yes, I believe the (unforunately) right decision was made in this case. Yes, I wish it were otherwise. Yes, I hope someone untainted is working on an un-encumbered version.
