Sun owns the trademarks "Solaris" and "OpenSolaris".   The OpenSolaris
organization is an unincorporated group, with no legal basis to sign
licenses.   In pure legal terms, OpenSolaris.org is a web site owned
and operated by Sun Microsystems, Inc. which it allows use of by the
public, to varying degrees.

That is not in dispute - we all agree Sun has the legal rights to do this.
No one will be filing lawsuit or any sort of legal grievance against Sun
over this issue, nor is there any basis for one.

The dispute is over whether or not Sun is upholding the promises it
has made in the past to allow the community as a whole, including both
those employed by Sun and those who are not, to make the decisions
about the ongoing development of the OpenSolaris project.  There is no
legal contract signed with anyone requiring they do so, just community
goodwill to be lost when they don't.
