This is a claim that has not yet been proven.

With the usual interpretation of the GPL, a CDDLd ZFS could be used from the 
Linux kernel.

My impression is that some people don't like to see ZFS inside Linux and thus 
try to pretend license problems. You will not be able to change their minds 
even _if_ you change the license, so why do it?
