The community decided that no distro should not be called "OpenSolaris".
A copyright holder may respect the community or may not.....

Regardless of the legal rights, calling a distro "OpenSolaris" just creates 
unneeded confusion - but this was already discussed ad nauseum.

Is is not a wise decision to introduce a default that is responsible for making 
people unable to use ACLs or to create conformant tar archives.

Well, this has been mentioned many times before and much more than a year did
pass and there is still no solution for the problem.
