And I think it might be easier to sell the notion that marriage should not have any legal status though I grant that the difference would be a few percent. The difference doesn't need to be big because the margin for Prop 8 was so small. There are people out there who are expert at using targeted polling and focus groups to formulate ballot measures in the way that that they will be most popular.
