Yes, you are. However, you should consult with a lawyer if you have doubts -- This is not the appropriate forum on which to receive legal advice. However, I will point out how you misread it. Notice how it says (above) "Except as explicitly set forth below." That means, "what I am about to tell you is what you can and can not do, EXCEPT if I explicitly tell you otherwise below. They are making the general case "We own everything; It belongs to us; You can't distribute it to others". Then, in the paragraph below that they say that you can create derivative works based on the sample code as long as you include the copyright notice, "Portions copyright (c) 2000 Palm, Inc. or its subsidiaries. All rights reserved." Also, please note that at times the license refers to the "Software" and at other times, it refers to the "Sample Source Code".
