That company *does not* forfeit its rights to its intellectual property just 
because it has ceased to conduct business and/or it has filed for bankruptcy 
protection.

Only a judge with jurisdiction can allow use of XLR8's intellectual property 
which runs counter to XLR8's published intellectual property policies, unless 
and until the bankruptcy is settled.

And until then, XLR8's published terms and conditions are still valid and are 
enforceable.
