If Maxtor indicated on the package that the contents work with Macs, and part of the contents is a PCI ATA card, they're implying, unless they say otherwise, that the latter works with Macs also.
Unless consumer protection in Canada is worse than in the U.S., you should be able to get a refund from the retailer, regardless of whether the package is opened or not.
