If your monitor is set correctly the majority of the water will look quite 
dark, around 80% black I guess.

It looks to me like it's simply an exposure biassed towards preserving some 
colour and detail in the specular reflections of the sun which would push the 
surrounding areas into severe underexposure.

It's a similar effect to that used by Bob Talbot in his famous Dolphins shot:
