You're absolutely right about the litigation crap starting in the US, (soon to be) Snowfield Willie. It seems that what started out as shakedown civil lawsuits (because the lawyers know it's cheaper for opponents to settle out of court than to fight and win) have bled over into vague "untoward behaviour[sic]" laws with criminal or quasi criminal penalties - quite a different thing, actually.

I have a lawyer friend who has a most interesting oil painting back of his desk, above his head. Let me paint it for you. The scene is a court room showing the judge's bench with judge, witness box with a respondent, bailiff's podium with bailiff, jury box with jurors, bar with gallery behind and with spectators and the plaintiff's and respondent's tables just in front of the bar. The space between the bar, judge's bench, bailiff's podium and jury box is filled with turbulent water and two large shark fins are shown swimming in this arena.

How can anyone doing anything in public and on public property be considered to have any expectation of any kind of privacy extending yards or even feet from their person? Would this also extend to an oil artist painting the... ah... scene?

Why do people think they can do as they please in public and forbid others from doing as others please in public? Doesn't anyone accept responsibility for what they do down there? Don't folks understand that to preserve their own liberties, they must be tolerant of others liberties lest they be subject to restrictions of their own liberty in the future?

Frivolous litigation is rampant in the world, and I think the USA has to take credit for starting the trend. What this is, is the legislative version of it.
We were discussing it a while back, as an aside, with banning certain breeds of dogs.
The principle is the same.
